Terms of Service

You may only use the Service after creating an account. By registering an account, you enter into a binding agreement with Aletso VOF under these Terms of Service (“Terms”).

If you do not agree to these Terms, you must not use the Service.

Lensym is a survey platform available to individuals, companies and organizations. The Service enables users to create surveys, collect responses and analyse results.

Core features include survey design and creation tools, response management, analytics and reporting, and collaboration options. Additional features include custom branding, advanced logic and export tools, which may vary depending on the subscription plan chosen.

We may improve, update or modify the Service and its features as needed to enhance performance, security or user experience.

To access the Service, you must create an account and be at least 16 years old. When registering, you must provide accurate and complete information and keep it up to date.

You are responsible for maintaining the confidentiality of your login credentials and for all activities carried out under your account, unless such activities result from our negligence. You must notify us immediately if you become aware of any unauthorized access to your account.

We recommend that you choose a strong password and enable two-factor authentication, which is available in your account security settings.

You may use the Service only for lawful purposes and in accordance with these Terms.

Violation of this section may result in suspension or termination of your account in accordance with the Termination section below.

You remain the owner of all survey content and responses you create or collect through the Service (“Your Data”). Lensym does not claim any rights over Your Data, except for the limited purpose of storing and processing it to provide the Service.

Lensym offers different subscription plans with various features and usage limits. The current pricing and plan details are available on our website.

Subscriptions are billed either monthly or annually in advance. You may upgrade, downgrade, or cancel your subscription at any time, and any changes will take effect at the start of the next billing cycle.

Fees are non-refundable, except where required by law. If you are a consumer in the EU and you purchase a paid plan, you may have a legal right to withdraw from the purchase within fourteen (14) days, unless you agree to start using the Service immediately.

Our free plan includes certain usage limits. If you exceed those limits, you will need to upgrade to a paid plan to continue using the Service.

Lensym retains all intellectual property rights in the Service, including the platform software, features, design, documentation, and Lensym’s branding. Nothing in these Terms transfers ownership of the Service or its underlying technology to you. You may not copy, modify, distribute, sell, or reverse-engineer any part of the Service.

You remain the owner of the survey content you create, the responses you collect, your organization’s branding, and any analysis or reports generated from Your Data. By using the Service, you give us permission to store and process this content solely for the purpose of providing and improving the Service.

If you use a paid subscription plan, you may add your own organization’s branding to surveys and remove Lensym’s default branding. On the free plan, Lensym branding will remain visible by default. These branding permissions do not transfer any intellectual property rights: your branding remains yours, and Lensym retains all rights to its trademarks and brand materials.

We grant you a limited, non-exclusive, non-transferable licence to access and use the Service in accordance with these Terms and your selected subscription plan.

We aim to provide the Service in a reliable and consistent manner. However, we do not guarantee uninterrupted or error-free availability of the Service.

We aim to maintain a high level of availability and typically strive for an uptime of approximately 99.7%, excluding scheduled maintenance and circumstances beyond our reasonable control. This figure is an objective, not a guarantee.

Scheduled maintenance will be announced in advance where reasonably possible. Support is available by email for all users, with priority support offered under certain paid subscription plans.

We take reasonable measures to protect user data, including the use of automated backups. However, backups are not guaranteed, and users remain responsible for maintaining their own copies of important data.

We may temporarily suspend or limit access to the Service for maintenance, security reasons, legal obligations, or other operational reasons. Where reasonably possible, we will provide advance notice of such interruptions.

To the maximum extent permitted by applicable law, Lensym’s liability arising out of or in connection with the Service is limited as set out below.

Lensym is not liable for indirect, incidental, special, or consequential damages, including loss of profits, loss of business, or loss of data, except where such liability cannot be excluded under applicable law.

Subject to mandatory legal provisions, Lensym’s total liability for any claims arising during a twelve-month period is limited to the total amount paid by you for the Service during that period.

Nothing in these Terms excludes or limits Lensym’s liability for intent, gross negligence, death, personal injury, or any other liability that cannot be limited under Dutch or EU law.

Lensym is not responsible for data loss or damage resulting from user actions, third-party services, or circumstances outside its reasonable control.

You may terminate your account at any time through your account settings. Upon termination, your access to the Service will end.

Lensym may suspend or terminate your account if you materially breach these Terms. Where reasonably possible, we will provide notice before termination.

Following termination, you will have thirty (30) days to export your data. After this period, your data will be permanently deleted, unless retention is required by applicable law.

These Terms are governed by and interpreted in accordance with the laws of the Netherlands.

If you are a consumer residing in the European Union, you will benefit from any mandatory provisions of the law of the country in which you reside.

Any disputes arising out of or in connection with these Terms shall be submitted to the competent courts of the Netherlands, unless applicable consumer protection laws allow you to bring proceedings in your country of residence.

We encourage you to contact us first to attempt to resolve any dispute informally.

Consumers within the European Union may also submit complaints through the European Commission’s Online Dispute Resolution (ODR) platform.

Lensym may update or modify these Terms from time to time to reflect changes in the Service, legal requirements, or business operations.

If we make significant changes, we will notify you by email or through the Service at least fourteen (14) days before the changes take effect.

Unless otherwise stated, the updated Terms will become effective on the date specified in the notice. Changes will not apply retroactively. If you do not agree to the updated Terms, you may terminate your account before the changes take effect.

Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.
